This document (hereinafter simply referred to as the “Terms and Conditions”) governs the general terms and conditions of use of the website you have just accessed, owned by URBISRELAX LDA., as well as the terms and conditions for booking services at the hotel establishment named “NEXT LEVEL HOTELS” through this website.
INTRODUCTORY PROVISIONS
Identification of the owner of the website and operating entity of the establishment:
The owner of the website and operating entity of the establishment for which bookings can be made through the website is URBISRELAX LDA., with registered office at R. do Conde de Redondo, 16, 1150-186 Lisbon, Portugal, and VAT number (NIPC) 517402297, hereinafter referred to as “NEXT LEVEL HOTELS”.
User Information:
USE OF THE WEBSITE
The use of the website, whether through simple navigation or by establishing a commercial relationship with NEXT LEVEL HOTELS through the respective website, grants you the status of User and implies full and unreserved acceptance of all provisions included in these Terms and Conditions as well as in the Privacy Policy, in force at each moment you access the website.
These Terms and Conditions apply to all Users of the website, including, without limitation, visitors, customers, and others not specifically identified.
The contractual proposal regarding the booking of accommodation and additional services at the NEXT LEVEL HOTELS establishment on the website is addressed only to persons of legal age with full legal capacity who can therefore assume responsibility for the commitments resulting from the booking.
If the User does not agree with these Terms and Conditions in their entirety, they should not access the website or the features and services associated with it. In particular, making any and all bookings through the website depends on accepting these Terms and Conditions; therefore, if the User does not accept them, they will not be able to make bookings through it.
By accepting these Terms and Conditions, the User makes this acceptance on their own personal behalf and/or on behalf of the organisation they represent (if applicable). By making bookings through our website, the User declares that they are over 18 years of age, guaranteeing full legal capacity for the acts they perform and the necessary powers to make such acceptance. Furthermore, by accepting these Terms and Conditions, the User expressly declares that they will not use the website and the features and services associated with its use for any illegal and/or unlawful purposes.
NEXT LEVEL HOTELS reserves the right to amend these Terms and Conditions at any time and without prior notice. Therefore, the User should consult the Terms and Conditions prior to each use of the website and associated features and services.
Without prejudice to the provisions of the preceding paragraph, any amendments to the Terms and Conditions made after the confirmation of a booking will not bind the User regarding that specific booking. The Terms and Conditions in force on the date of confirmation of each booking will apply.
NEXT LEVEL HOTELS guarantees account security within expected and appropriate security measures for platforms such as the website.
NEXT LEVEL HOTELS is not responsible for damages resulting from interference, interruptions, computer viruses, faults, or disconnections in the operating system that may temporarily prevent access, navigation, or the provision of services to Users.
Under no circumstances may NEXT LEVEL HOTELS and/or its representatives and employees be held liable for any damages that may arise, even accidentally, from the malfunction of the website, on any grounds and regardless of the duration of such malfunction, or for any damages caused by reproduction, use, or exploitation.
Violation of the provisions of these Terms and Conditions by the User constitutes grounds for termination by NEXT LEVEL HOTELS. In any case, violation of the provisions of these Terms and Conditions by the User, regardless of whether termination is effected or not, always entitles NEXT LEVEL HOTELS to be indemnified for all resulting losses. Furthermore, NEXT LEVEL HOTELS reserves the right, at its sole discretion, to terminate the User’s use of the website and its respective features and services, with or without notice.
PRICES, CHILDREN AND ACCOMMODATION
Price of accommodation and additional services
- The prices of accommodation and additional services at NEXT LEVEL HOTELS are clearly indicated on the website, in Euros, including VAT at the legal rate in force.
- The prices shown are per accommodation unit; however, they may be presented based on other features, which will in any case be clearly indicated on the website when making a booking.
- Although NEXT LEVEL HOTELS attempts to ensure that all prices displayed on the website are correct, errors may occur. If NEXT LEVEL HOTELS detects an error in the price of any accommodation or service booked by the User, it will inform them as soon as possible and offer the option to reconfirm the order at the correct price or cancel it. If NEXT LEVEL HOTELS is unable, for any reason, to contact the User, the booking will be cancelled, and the amount already paid will be fully refunded within 30 days.
- The price of accommodation and additional services is subject to change by NEXT LEVEL HOTELS without prior notice, up until the moment the booking is confirmed by the User.
Children
- All children are welcome. Guests aged 18 or over will be required to pay adult rates.
- The conditions and costs for cots and extra beds vary depending on the time of year; please contact the reservations department.
Accommodation
- The characteristics of NEXT LEVEL HOTELS are those specified in the booking. However, since the photographs were not taken on the date the booking was made by the User, non-substantial differences may exist between the photograph and the reality on the date the contracted services are enjoyed, which do not entitle the User to any modification of the Contract.
- Unless otherwise stated in the booking, it includes accommodation only, with no meal plan included.
- Should the User arrive with more people than indicated in the booking to use the accommodation, NEXT LEVEL HOTELS may refuse entry, a situation for which NEXT LEVEL HOTELS cannot be held responsible.
CANCELLATION POLICY, TIMINGS AND ACCESS
Cancellation Policy
- Booking cancellation will be free of charge if made up to 7 (seven) days before the booked date, with the full amount paid being refunded.
- If cancellation is made less than 7 (seven) days before the booked date, it will result in the loss of 100% of the amount paid by the User at the time of booking.
Check-in and Check-out times
- Check-in time: from 16:00;
- Check-out time: until 11:00.
Access to Next Level Hotels
- NEXT LEVEL HOTELS may refuse access to anyone who disrupts its normal operation, in situations of drunkenness, violent behaviour, public indecency, or any other attitude contrary to good customs and social harmony by any Guest or their invitee.
ONLINE BOOKING PROCESS
Online Bookings
- When making any booking, the User must correctly fill in the respective form, specifying, in particular, the check-in and check-out dates, the type of accommodation required and associated extras, and the number of people, specifying the children and infants who will occupy the accommodation—always subject to confirmation of availability by NEXT LEVEL HOTELS—as well as their personal details and payment information, taking full responsibility for the choices made and the information provided, which must be complete, truthful, and up to date.
- To start the booking, the User must click on "BOOK ONLINE" on the website. They should then:
– Select check-in and check-out dates;
– Indicate the number of adults and children;
– Choose the preferred room category;
– Click on “BOOK NOW”.
- A booking summary will be displayed, including rooms, dates, and number of guests. At this stage, the User must enter their personal details, including:
– Country;
– Full name;
– E-mail address;
– Phone number;
– Address;
– Purpose of stay;
– Option to add special requests.
- After entering personal details, the User must click "BOOK NOW" again to proceed.
- The User will be informed of the total price of the booking, including any additional fees and optional service expenses, as well as check-in and check-out times.
- The User must pay for the booking exclusively by credit or debit card, using the payment methods provided on the website.
- Before confirming the booking, the User undertakes to verify all booking details, including selected rooms, dates, number of guests, prices, and payment method, correcting any errors before confirmation.
- Before finalizing the booking, the User must read the "Terms and Conditions", placing a mark of agreement in the available checkbox, only if they accept them. Acceptance of the "Terms and Conditions" is an absolute requirement to proceed with the transaction. The User should immediately print and file the Terms and Conditions for future reference.
- Upon confirming the booking, the User enters into a Contract with NEXT LEVEL HOTELS, fully accepting the room descriptions, prices, and these Terms and Conditions, which contain the sole provisions applicable between the User and NEXT LEVEL HOTELS.
- An e-mail will then be sent to the User detailing the booked service(s), price(s), Special Conditions accepted by the User, the date of the booking, information regarding the Terms and Conditions, as well as the contact details of NEXT LEVEL HOTELS to which the User may address any complaints.
- The booking will only become effective upon full payment of the amount due, where applicable. The invoice will be issued in digital format and sent to the e-mail provided by the User, and cannot be reissued with subsequent amendments.
FINAL PROVISIONS
Intellectual Property
- URBISRELAX LDA. is the owner of all intellectual property rights on the website.
- The contents made available by NEXT LEVEL HOTELS through the website, including, without limitation, texts, images, design, trademarks, logos, and source codes, are protected by intellectual property legislation, with ownership or licensing held by URBISRELAX LDA. and its suppliers or licensors. As such, its contents, as well as any other elements protected by intellectual property rights, may not be copied, imitated, or used, in whole or in part, without prior written authorization from URBISRELAX LDA. or the respective holder of the applicable intellectual property right, which the User acknowledges and accepts.
- The User acknowledges that access to the website and its respective contents does not grant them any ownership rights or licence over the materials and contents made available therein.
- The User undertakes not to make any abusive use of these contents, and they may not be copied, disclosed, or used in any way, nor may software tools be used to collect protected content, namely robots, crawlers, or other automated mechanisms.
- The User will not copy, translate, disassemble, or decompile, nor create or attempt to create, by reverse engineering or otherwise, the source code and object code of the Platform, as well as third-party tools and applications and software associated with its functionality, nor remove any confidentiality or intellectual property notices.
- The User undertakes to fully indemnify NEXT LEVEL HOTELS for any compensation, costs, or expenses it may incur as a result of claims of any kind or nature directed against it by third parties based on the infringement of third-party rights, namely intellectual property rights related to the use of content made available, supplied, or placed at disposal through the site and its associated services, including compensation paid to third parties by agreement with them.
Protection of Personal Data
URBISRELAX LDA., as the data controller, respects your privacy. Any personal data collected on the website will be kept confidential and will not be sold, communicated, or in any way reused by third parties without your authorization. Any personal data provided to us will be processed in accordance with current legislation, best practices, and ensuring all technical and organizational security measures necessary for its protection. Liability
To the maximum extent permitted by law, NEXT LEVEL HOTELS will only be liable for damages caused by gross negligence or wilful misconduct. NEXT LEVEL HOTELS assumes no responsibility for the continuous availability of its website, particularly regarding mobile networks, the Internet, and mobile devices.
User Support and Complaints
Alternative Dispute Resolution
- The provisions of this clause apply exclusively to bookings made by final consumers, as defined in Law no. 24/96, of 31 July, as amended.
- NEXT LEVEL HOTELS informs that, under the Consumer Protection Law, consumer disputes of low economic value (under €5,000.00) are subject to mandatory arbitration or mediation whenever, by express choice of consumers, these are submitted to the assessment of an arbitral tribunal attached to legally authorized consumer dispute arbitration centres. Thus, in the event of a dispute, the final consumer may resort to any of these means, and must be represented by a lawyer or legal representative (or request legal aid, under the legally provided terms).
- Furthermore, under Reg. (EU) 524/2013 of the European Parliament and of the Council, the User can access the Online Dispute Resolution (ODR) Platform at https://webgate.ec.europa.eu/odr/main/index.cfm?event=main.home.chooseLanguage, where information is provided regarding the possibility of using it to resolve disputes.
- Information regarding available Alternative Dispute Resolution entities for promoting the extrajudicial resolution of national and cross-border disputes under Law no. 144/2015, of 8 September, as amended, is also available on the Consumer Portal (consumidor.pt), when initiated by a consumer against a supplier of goods or service provider concerning contractual obligations resulting from sales or service contracts concluded between established suppliers/service providers and residents in Portugal and the European Union.
The user declares to have read and understood these general conditions, as well as the policies associated with them, and that they had the opportunity to seek independent legal advice before accepting them. They further acknowledge that this constitutes the complete and exclusive statement of the agreement between them and next level hotels, which supersedes any previous proposal or agreement, written or oral, and any other communication between them and next level hotels regarding the subject matter of this contract.
